Terms Of Service

Garden Picasso ("we," "us," or "our") provides landscape consulting, design, installation, and stewardship services. By purchasing our services, using our website, or downloading our digital plans, you agree to be bound by the following Terms of Service.
 

1. SCOPE OF SERVICES & DISCLAIMER
 

Garden Picasso is a landscape design, installation, and horticultural consulting firm.
 

  • Not Licensed Architects/Engineers: We are not licensed Landscape Architects, Civil Engineers, or Land Surveyors in the State of Louisiana. Our services, including the "Renaissance Protocol" and "Mud to Masterpiece" plans, are conceptual design and horticultural consultations.
     

  • Permitting & Compliance: While we design with best practices in mind, it is the Client’s responsibility to verify that all plans comply with local HOA, city, and parish codes. Any drainage plans should be reviewed by a licensed professional if required by local law.
     

2. PHASE 2: INSTALLATION SERVICES & AGREEMENTS
 

Any physical installation work performed by Garden Picasso operates under the following terms, which are agreed upon signature of the Installation Proposal.
 

  • Underground Utilities & Hidden Obstacles: Garden Picasso will contact Louisiana One Call (811) to mark public utilities prior to excavation. However, the Client is strictly responsible for identifying and marking all privateunderground lines (e.g., irrigation, landscape lighting, invisible fences, private drainage). Garden Picasso is not liable for damage to unmarked private lines. If hidden subterranean obstacles (e.g., buried concrete, massive root systems, debris) are discovered during excavation that require extra labor or machinery, a Change Order will be issued for the additional cost.
     

  • Material Substitutions: Due to the nature of living goods and nursery stock fluctuations, Garden Picasso reserves the right to substitute plants or materials with items of equal value, size, and aesthetic intent if the original items become unavailable. The Client will be notified of major substitutions.
     

  • Scope of Work & Change Orders: The Installation Proposal covers only the exact items and labor listed. Any mid-project additions requested by the Client (e.g., "Can we add a few more plants over here?") must be approved via a written Change Order and will incur additional material and labor costs.
     

  • Living Material Warranty: Garden Picasso ensures all plants and materials are installed according to Green Infrastructure industry standards. We offer a 30-day survival guarantee on woody trees and shrubs, provided the Client adheres to the provided watering and maintenance schedule. This warranty is voided in the event of extreme weather (hurricanes, freezes, floods), vandalism, or neglect. (Note: Joining our ongoing Stewardship Program extends the health monitoring of your landscape).
     

3. DIGITAL PRODUCTS & REFUND POLICY
 

All sales of Digital Products and Diagnostic Audits are FINAL.
 

  • Digital Goods: Because our "Master Plans," "Scopes of Work," and "Design PDFs" are digital intellectual property that cannot be returned, we offer no refunds once the file has been delivered or sent via email.
     

  • Audits: The $199 Stormwater Readiness Audit fee covers the time and diagnostic expertise of the technician. Once the site visit has occurred, this fee is non-refundable, regardless of the findings.
     

  • Retainers: Monthly Stewardship Retainers may be cancelled with 30 days' written notice. No refunds will be issued for partial months.
     

4. PAYMENTS
 

  • Audits: Payment for the Stormwater Readiness Audit is due upon booking or prior to the site visit.
     

  • Design Services: Design fees (e.g., Renaissance Protocol) typically require a 50% deposit to begin work, with the remaining balance due upon delivery of the final plan.
     

  • Late Fees: Invoices unpaid after 15 days are subject to a 10% late fee.
     

5. LIMITATION OF LIABILITY (FLOODING)
 

Garden Picasso provides risk reduction, not flood immunity. We utilize data and horticultural engineering to improve drainage and soil absorption. However, due to the extreme nature of New Orleans weather, soil subsidence, and municipal infrastructure failures, we cannot and do not guarantee that your property will never flood. We are not liable for water damage, foundation issues, or "Acts of God."
 

6. INTELLECTUAL PROPERTY

All designs, drawings, "Mud to Masterpiece" plans, and "Stewardship Reports" produced by Garden Picasso remain our intellectual property.
 

  • License to Use: Upon full payment, the Client is granted a non-exclusive license to use the designs for the specific property intended.
     

  • Distribution: You may not resell, publish, or distribute our technical plans without our written consent.
     

7. PROMOTIONAL SIGNAGE & MEDIA RIGHTS
 

Client agrees to allow Garden Picasso to place a temporary, branded promotional sign (measuring no larger than 18”x24”) on the property during the active installation phase, and for a period of up to fourteen (14) days following the final completion of the project. Garden Picasso will retrieve the sign at the end of this period. Additionally, Client grants Garden Picasso the right to capture photographs and video of the project (before, during, and after completion) for marketing, educational, and portfolio purposes, provided that no private identifying information (such as house numbers) is prominently displayed without prior consent.
 

8. AFFILIATE & PARTNER DISCLOSURE
 

Garden Picasso may recommend third-party contractors (such as W&E Landscaping LLC, GreenLand NOLA, etc) for installation or maintenance services.
 

  • Independent Entities: These partners are independent businesses. Garden Picasso is not liable for their workmanship, scheduling, or billing.
     

  • Referral Fees: We may receive a commission or referral fee for connecting you with these service providers.
     

9. GOVERNING LAW
 

These Terms shall be governed by the laws of the State of Louisiana. Any disputes arising from this agreement shall be resolved in the courts of Orleans Parish.
